1. Acceptance
By creating an account or using Quest-ly, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
2. Eligibility & Age
You must be 13+ to use Quest-ly. In the EEA/UK, you must be 16+ (or have verifiable parental consent where permitted). We do not knowingly allow under-13s.
3. Accounts
Keep your login credentials secure. One natural person per account. We may suspend or terminate accounts for violations, fraud, or risk to users. Account deletion is available in the app via Profile → Settings (top-right icon) → Edit Profile → Delete Account.
4. App Permissions
Quest-ly may request:
- Camera/Microphone (proofs)
- Photos (uploads)
- Location (Local Area quests, nearby visibility, Travel mode, and inside-zone eligibility checks for Local Area responses)
- Notifications (reminders)
You can revoke permissions in device settings; some features may be limited.
Local Area & Travel mode: Local Area quests are set by map center and radius (up to 5 km) and may be visible to nearby users. To submit a response to a Local Area quest, users may need to be inside the zone and location checks may be used to enforce this. Travel mode can temporarily enable quests for another city and can be disabled in settings.
5. User Content & License
You retain ownership of content you create or upload. By posting, you grant Quest-ly a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your content within Quest-ly and for Quest-ly’s promotion (e.g., app store listings, screenshots, social posts) in connection with the service. You warrant you have the rights to post such content.
Each quest and each response can include one piece of media (one photo or one video).
Feedback: You grant Quest-ly a perpetual, irrevocable, royalty-free license to use feedback without obligation.
6. Acceptable Use & Safety
Prohibited: illegal acts/content; hate or harassment; exploitation; sexual content involving minors; doxxing; incitement to violence or self-harm; spam, cheating, bots, scraping; IP infringement; malware; regulated or illegal goods/services; privacy violations.
Safety: Real-world challenges carry risk. Participate at your own risk. Use common sense, follow local laws, wear appropriate protection, and do not attempt tasks beyond your ability. Quest-ly does not provide professional advice.
7. Leaderboards & Anti-Cheat
We may apply rate limits, repeated-action detection, and location consistency checks (including Local Area quests). We may audit activity and invalidate or remove content, points, or ranks, and limit features where manipulation or abuse is suspected.
8. Moderation & Appeals
We may remove content or restrict/terminate accounts at our discretion. Moderation may use automated systems and human review, and automated systems may flag, restrict, or remove content. You may appeal decisions via [email protected].
9. Third-Party Links & Venues
Quest-ly is not responsible for third-party sites, venues, schedules, or conditions referenced in quests.
10. In-App Purchases & Virtual Items
Advertising payments and top-ups. Quest-ly offers optional advertising tools. If you choose to top up your advertising balance to run campaigns, your purchase will be processed by our payment providers. On iOS, top-ups are processed through Apple In-App Purchase (StoreKit) and are subject to Apple's terms. On other platforms, top-ups may be processed by Stripe. Quest-ly does not store full payment card details. Advertising balance is used only for advertising spend within Quest-ly and is not a bank account or stored value account.
Refund requests for iOS in-app purchases are handled by Apple. For other platforms, refunds (if applicable) are handled through the payment provider and your card issuer's rules.
11. Intellectual Property & Takedown
Report IP concerns to [email protected]. For copyright, send a DMCA-style notice to [email protected]; we will respond under applicable law.
12. Disclaimers
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Your consumer rights may vary by jurisdiction.
13. Limitation of Liability
To the maximum extent permitted, Quest-ly is not liable for indirect or consequential losses. Direct liability is limited to the greater of £100 or amounts you paid to Quest-ly in the last 12 months. Your statutory consumer rights remain unaffected.
14. Indemnity
You agree to indemnify and hold Quest-ly harmless from claims arising from your content or violations of these Terms.
15. Governing Law & Venue
These Terms are governed by the laws of England & Wales; courts of England have non-exclusive jurisdiction. Consumers may bring claims in their country if mandatory law provides that right.
16. Changes
We may update these Terms. Material changes take effect after 14 days from in-app notice (or sooner if required by law or for safety/security).
